Personal Injury in Cyprus
Personal Injury is the term used usually to describe an injury to body and/or mind and/or emotions caused by the negligent conduct of another party. The most common type of Personal Injury claim in Cyprus are relates to car accidents. Claims relating to medical negligence, tripping accidents and accidents at work are not so common in Cyprus. This is mostly because many Cypriots are not aware of their legal rights and what they can and in court for proceedings for such matters. Nonetheless, there is still the legal right in Cyprus to claim compensation for any type of personal injury caused by the negligence of another party.

Types of Damages
There are 2 types of damages: General Damages and Special Damages:
- General Damages: These are not measurable damages such as bodily harm, emotional and psychological trauma, pain and suffering and loss of amenity.
- Special Damages: These are measurable damages such as loss of earnings, medical expenses and any financial expenses incurred directly linked to the injury.
Personal Injury Process
If the party responsible for the negligence is insured and the insurance covers the negligent acts, the lawyer of the person who suffered the injury will normally be the one to negotiate with the insurance company to seek to obtain a reasonable compensation. As it normally happens in the Cyprus with road traffic accidents is that in the case that the insurance company doesn’t make an offer that is acceptable or reasonable then this is the point where the lawyer of the claimant comes in and takes matter to the court. It is then up to the judge to decide as to what is a fair and reasonable compensation. If the party who caused the Personal Injury is not insured with any insurance company then the lawyer of the claimant seeks to negotiate directly with the person or if deemed necessary proceed with Court proceedings.
How to Determine Damages
When it comes to personal injury compensation there is no certainty as to specific amount a claimant can receive either by the insurance company or what the court will agree upon. However, certain types of injuries will generally receive a similar amount as damages. For example, a whiplash will receive a small compensation being around €1000-2000. A very serious personal injury such as loss of vision, kidney damage and other serious disabilities would receive a much higher compensation.
